TRADING TERMS AND CONDITIONS


Acceptance of Terms and Conditions

When you submit your order to DanceForce you are confirming that you accept the content of our terms and conditions. All orders placed by you are subject to acceptance by DanceForce and product availability.

Payment Terms

NO MINIMUM ORDER REQUIRED.  All orders are proforma.  Full payment is required with order, by credit card or debit card. We accept most major credit cards.

Personal Guarantee of Limited Company’s Obligations

Payment obligations arising from orders placed by Limited company customers are taken to be jointly, severally and personally guaranteed by the directors of the company. By submitting your order you confirm that you have the authority of the directors to extend their personal guarantee to DanceForce.

Back Orders

Items over the value of £5.00 which are not available at the time of order will be placed on back order, unless otherwise stated.

Change to Account Details

Any changes to account details must be received in writing prior to the changes being made. We are unable to accept changes to account details by telephone.

Made to Order Items

Any items which are Made to Order must be paid for at the time of ordering and are non-returnable.

Sizing Samples

Only one item per size can be offered on a Sale or Return basis. We are unable to offer sizing samples to be ordered online and orders for these items will need to be placed on a separate order via our Sales Team.

Prices

All prices are those ruling at date of delivery and are subject to change without notice. DanceForce endeavours to maintain the pricing set out in its catalogues but these may be subject to change. VAT rates may vary dependent upon the country of destination and will be charged at the applicable rate.

Any items offered at a Sale/Discounted price are available from the first date of the offer only.  No retrospective discounts will be applied.

Delivered Parcels

All parcels received must be checked at the time of delivery.  Only the number of boxes received should be signed for.  Any damaged parcels received should be signed for as damaged, and photographs should be taken of the damaged parcel to substantiate any claim.  Any items received damaged must be notified in writing to DanceForce within 7 days of date of delivery.

Non-Delivery of Parcels

In the unfortunate event that our parcel does not arrive after despatch from DanceForce within the delivery service expected time you must inform us.

Dependent upon the delivery service used we are able to raise a claim on your behalf.  There are time restraints applicable for each delivery provider.

In such an event we can re-despatch your order on a new invoice in conjunction with your account status.  No invoices will be refunded until the claim has been finalised.

Returns

IMPORTANT! Do not send any returns to the PO Box, they will not be accepted.  Please send any returns to the warehouse facility at: The GD Company, Unit H7/9, Blackpole East, Blackpole Road, Worcester. WR3 8SG.

All of our garments are checked prior to despatch but should still be checked before use, as we do not accept worn clothing back, unless a fault has quickly revealed itself after initial wear.  In such isolated cases the garments need to be washed before return.  Tights in particular will not be accepted back for any reason unless unworn.

Please ring for a returns authorisation number which must be clearly marked on the outside of the box as well as on the RETURNS NOTE. 

Any items returned without the correct paperwork will be charged a standard handling fee of £6.00 per parcel.  A 30% handling charge will be levied on all non-faulty goods returned.   Returned goods which are not faulty must be in their original unmarked packaging, and must be returned within 28 days of invoice.  Any necessary re-packing will be charged at £2.50 + VAT per item.  Please mark faults with sticky tape to identify the problem.  A receipt of postage should be obtained for all returned items.  Credit notes are issued on receipt of returned goods and your account is automatically credited.  Refunds to credit/debit cards will not be done automatically.

Please note that garments which are not regular stock items will not be accepted back for credit.  For reasons of hygiene we are unable to exchange or credit hats, wigs, underwear or non-clip earrings even if returned unworn.  CD’s, DVD’s and fabrics are also non-returnable.

Items purchased from our CLEARANCE or SALE are non-returnable unless faulty at time of delivery.  You must notify us within 7 days of any faulty goods.

Please be aware that returned items may take up to 28 days to be processed.

Discrepancies

Please note that any discrepancies must be informed within 3 days .

Conformity of Goods

Every care is taken to ensure that the specification and description of our products are correct at the time of going to print.  However, descriptions and specifications of products in this catalogue are not intended to be binding and are only to give a general description of the products.  Colour reproduction of the products is a close representation.  However, we cannot accept any responsibility for any variation in colour caused by the printing process.  All our products are intended for children aged 3 years or above.

Data Protection

As required by the UK Data Protection Acts of 1984 and 1998, we follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access.  DanceForce will not sell or pass on your details to third parties unless required for the purpose of fulfilling your order.  Our security procedures mean that we may occasionally request proof of identity before we are able disclose sensitive information to you.

Intellectual Property

All materials within the catalogue, including photography, images, design, text and graphics are the intellectual property of DanceForce or its licensor.  The copying of such materials is strictly forbidden.  DanceForce is the trademark of DanceForce.  Other product and company names referred to in this catalogue may be registered or unregistered trademarks of their respective owners and are used by DanceForce under licence.

Liability

The maximum liability of DanceForce to you under contract tort or otherwise for any loss whether direct or indirect is limited to the price of the products purchased to the maximum extent permitted by law.

We do not accept liability for any errors and/or omissions contained in our catalogue and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.

DanceForce shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products.  Nothing in these terms and conditions (whether or not under the heading of Liability) shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Retention to Title

The Property and Title, both legal and equitable, in any merchandise sold or agreed to be sold by DanceForce will not pass to the Customer until all sums due to DanceForce have been paid in full.

Law and Jurisdiction

These terms and conditions are subject to English law.  In placing your order you agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.

Online – Password Privacy

DanceForce shall not be liable to any person for loss or damage which may arise as a result of any failure by you to protect your password or account.  You are responsible for the confidentiality of your password and account and any activities that occur under your account.

Postage

Please allow approximately 3-5 working days for delivery of stock items. Please advise us if your order is urgent and we will do our very best to ensure we meet your deadline.
